PALAUTUKSET JA PERUUTUSOIKEUS

1. Peruutusoikeus

Kuluttajalla on kuluttajansuojalain mukainen 14 vuorokauden peruutusoikeus etämyynnissä ostetuilla tuotteilla.

Peruutusoikeus koskee Kogle Helsinki Oy:n perusmalliston tuotteita, joissa asiakas tekee valintoja myyjän tarjoamasta vakiovalikoimasta (esimerkiksi materiaali, väri tai verhoilu).

Peruutusoikeuden käyttämiseksi asiakkaan tulee ilmoittaa peruutuksesta kirjallisesti 14 päivän kuluessa tuotteen vastaanottamisesta.

2. Peruutusoikeuden poissulkeminen – erikoistilaukset

Peruutusoikeus ei koske tuotteita, jotka on valmistettu asiakkaan yksilöllisten vaatimusten mukaisesti tai jotka on selkeästi räätälöity asiakkaan toiveiden perusteella.

Tällaisia erikoistilauksia ovat esimerkiksi:

  • poikkeavat mitat tai istuinkorkeus

  • rakenteelliset muutokset

  • erikseen asiakkaalle hankitut materiaalit

  • mallistosta poikkeavat toteutukset

Peruutusoikeuden puuttumisesta ilmoitetaan asiakkaalle ennen tilauksen vahvistamista.

3. Tilauksen peruuttaminen ennen valmistuksen aloittamista

Asiakas voi peruuttaa tilauksen ennen tuotteen valmistuksen aloittamista tekemällä kirjallisen ilmoituksen sähköpostitse osoitteeseen kogle@kogle.fi.

Kogle Helsinki Oy pidättää oikeuden vahvistaa, onko valmistus jo aloitettu.

4. Palauttaminen

Peruutusoikeuden piirissä olevat tuotteet tulee palauttaa:

  • käyttämättöminä

  • myyntikuntoisina

  • alkuperäispakkauksessa

Tuote on toimitettava takaisin viipymättä peruutusilmoituksen tekemisen jälkeen.

Asiakas vastaa palautuskustannuksista, ellei toisin ole sovittu.
Asiakas vastaa palautuksen aikana siitä, että tuote säilyy vahingoittumattomana.

5. Virheellinen tai väärä tuote

Mikäli toimitettu tuote on virheellinen tai ei vastaa sovittuja ominaisuuksia, asiakkaan tulee ilmoittaa asiasta viipymättä, kuitenkin viimeistään 14 päivän kuluessa tuotteen vastaanottamisesta.

Reklamaatiot pyydetään lähettämään osoitteeseen kogle@kogle.fi.

Kogle Helsinki Oy käsittelee reklamaation kuluttajansuojalain mukaisesti ja pyrkii ensisijaisesti korjaamaan tuotteen, vaihtamaan sen tai palauttamaan kauppahinnan.

6. Tilanteet, joita ei pidetä virheinä

Seuraavia tilanteita ei pidetä tuotteen virheinä kuluttajansuojalain tarkoittamalla tavalla:

  • poikkeavat olosuhteet, kuten äkilliset lämpötilanvaihtelut tai kosteus, jotka ovat aiheuttaneet tuotteen vahingoittumisen

  • vahingot, jotka johtuvat virheellisestä asennuksesta tai asiakkaan tai kolmannen osapuolen tekemistä muutoksista ilman myyjän hyväksyntää

  • tuotteen vahingoittuminen sen jälkeen, kun se on luovutettu asiakkaalle, esimerkiksi jatkokuljetuksen aikana

  • luonnollinen kuluminen, ikääntyminen tai valon aiheuttama haalistuminen

  • asiakkaan tai kolmannen osapuolen tuotteeseen lisäämät materiaalit

  • luonnonmateriaalien, kuten massiivipuun, nahan, kankaiden tai luonnonkivien, luonnolliset eroavuudet ja yksilölliset piirteet

7. Virhevastuu ja riidanratkaisu

Kogle Helsinki Oy:llä on lakisääteinen virhevastuu myymistään tuotteista.

Kuluttajalla on oikeus saattaa mahdollinen riitatilanne kuluttajariitalautakunnan käsiteltäväksi.

8. Muuta

Kogle käyttää luonnonmateriaaleja, joiden sävy, rakenne ja kuviointi voivat vaihdella.
Tuotekuvat ovat suuntaa-antavia, ja näytön asetukset voivat vaikuttaa värien toistumiseen.

Pidätämme oikeuden tehdä muutoksia peruutus- ja palautusehtoihin.
Asiakkaan velvollisuus on tutustua voimassa oleviin ehtoihin ennen tilauksen tekemistä.

RETURNS & RIGHT OF WITHDRAWAL

1. Right of Withdrawal

Consumers have a statutory 14-day right of withdrawal for products purchased through distance selling, in accordance with applicable consumer protection legislation.

The right of withdrawal applies to Kogle Helsinki Oy’s standard collection products, where the customer makes selections from the seller’s predefined options (such as material, colour, or upholstery).

To exercise the right of withdrawal, the customer must notify Kogle Helsinki Oy in writing within 14 days of receiving the product.

2. Exclusion of the Right of Withdrawal – Special Orders

The right of withdrawal does not apply to products that are manufactured according to the customer’s individual requirements or otherwise clearly customised to the customer’s specifications.

Such special orders may include, for example:

  • non-standard dimensions or seat heights

  • structural modifications

  • materials sourced specifically for the customer

  • executions deviating from the standard collection

The absence of the right of withdrawal will be clearly communicated to the customer before order confirmation.

3. Cancellation Before Production Begins

The customer may cancel the order before production of the product has begun by submitting a written notice by email to kogle@kogle.fi.

Kogle Helsinki Oy reserves the right to confirm whether production has already commenced.

4. Returns

Products subject to the right of withdrawal must be returned:

  • unused

  • in resalable condition

  • in their original packaging

The product must be returned without undue delay after the withdrawal notice has been submitted.

The customer is responsible for return shipping costs unless otherwise agreed.
The customer is responsible for ensuring that the product remains undamaged during return transport.

5. Defective or Incorrect Products

If the delivered product is defective or does not correspond to the agreed specifications, the customer must notify Kogle Helsinki Oy without undue delay, and no later than 14 days after receiving the product.

Complaints should be submitted to:

Kogle Helsinki Oy will handle the complaint in accordance with applicable consumer protection legislation and will primarily seek to repair the product, replace it, or refund the purchase price.

6. Situations Not Considered Defects

The following situations are not considered defects within the meaning of consumer protection legislation:

  • damage caused by exceptional conditions, such as sudden temperature changes or humidity

  • damage resulting from improper installation or modifications made by the customer or a third party without the seller’s approval

  • damage occurring after the product has been handed over to the customer, including during subsequent transport

  • natural wear and tear, ageing, or fading caused by light exposure

  • materials added to the product by the customer or a third party

  • natural variations and individual characteristics of natural materials, such as solid wood, leather, fabrics, or natural stone

7. Statutory Liability for Defects and Dispute Resolution

Kogle Helsinki Oy is subject to statutory liability for defects in accordance with applicable consumer protection legislation.

Consumers have the right to refer disputes to the Consumer Disputes Board.

8. Miscellaneous

Kogle products are made using natural materials, the colour, texture, and grain of which may vary.
Product images are indicative only, and display settings may affect colour representation.

Kogle Helsinki Oy reserves the right to make changes to these returns and cancellation terms.
Customers are responsible for reviewing the applicable terms before placing an order.
